The hierarchy of courts is as follows..
Supreme Court
"A" court
Trial Court.
Lower courts are not allowed to question the rulings of higher courts. If the supreme court says that pot is not legal, california courts are not allowed to legalize it for medical use.
Apart from not being able to go up the ladder, courts are also not allowed to change past rulings of the same court unless there is a very great need to. The Dread Scott case is a perfect example of an acceptable time to break this "Horizontal Stare" rule. If the court sees that a grave mistake was made in the past, they are allowed to correct it.
Issues at hand right now involve the Wade v Rowe (?) case of 197...3? Which legalized abortion(?) (This is why Faeries dont make good lawyers. they dunno wth theyre talking about half the time).
It is being brought into question whether the court is allowed to change/abolish/whatever this law in favour of a new one.
